Terms and Conditions

1. Acceptance of Terms

By accessing or using Bet-You-Won't.com ("Site"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree, do not use the Site or make any contributions.

2. Eligibility

You must be at least 18 years of age and a legal resident of a jurisdiction where use of this Site and making voluntary monetary contributions is lawful. By using the Site, you represent and warrant that you meet these requirements.

3. Nature of Contributions

All monetary contributions made through this Site are entirely voluntary, non-refundable payments to Bet-You-Won't.com. Contributions are NOT charitable donations, tax-deductible gifts, investments, loans, purchases of goods or services, or entries into any sweepstakes, lottery, or contest. You will receive no financial return, product, service, equity, or other tangible benefit in exchange for your contribution, other than optional display of your chosen name and contribution amount on the Site's public leaderboard. Bet-You-Won't.com is not a registered nonprofit, charity, 501(c)(3) organization, or investment vehicle of any kind.

4. Leaderboard and Display Names

Contributors may optionally provide a display name for the public leaderboard. Display names must not contain offensive, defamatory, or infringing content. Sponsor reserves the right to remove or modify any display name at its sole discretion. Badges and titles displayed on the leaderboard are for entertainment purposes only and confer no rights, privileges, or monetary value.

5. Refund Policy

All contributions are final and non-refundable. By completing a payment, you acknowledge that you are voluntarily transferring funds with no expectation of return. Chargebacks or fraudulent payment reversals may result in removal from the leaderboard and, where permitted by law, pursuit of applicable remedies. Under the Colorado Consumer Protection Act (C.R.S. 6-1-101 et seq.), this refund policy is clearly disclosed prior to any transaction.

6. Payment Processing

Payments are processed by third-party payment services (currently Cash App; additional card processing options as they become available). Your payment information is transmitted directly to these services and is never stored by Bet-You-Won't.com. Use of these payment services is subject to their respective terms and privacy policies.

7. Use of Funds

Contributions received by Bet-You-Won't.com are the property of Bet-You-Won't.com and may be used at the sole discretion of its operators for any lawful purpose, including but not limited to operating costs, marketing, compensation, and other business expenses.

8. Intellectual Property

All content on the Site is the property of Bet-You-Won't.com and is protected by applicable copyright, trademark, and other intellectual property laws.

9. User Conduct

You agree not to: (a) use the Site for any unlawful purpose; (b) attempt to interfere with the operation of the Site; (c) use automated tools to interact with the Site; (d) submit false or misleading information; (e) attempt to manipulate leaderboard rankings through fraudulent means; or (f) harass other users.

10. Dare a Friend Feature

The "Dare a Friend" feature generates shareable links that include a friend's first name for entertainment purposes. By using this feature, you represent that you have a personal relationship with the named individual and are not using it to harass, bully, or target any person.

11. Disclaimer of Warranties

THE SITE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BET-YOU-WON'T.COM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. Total aggregate liability shall not exceed the amount of your most recent contribution or Ten U.S. Dollars ($10.00), whichever is less.

13. Indemnification

You agree to indemnify, defend, and hold harmless Bet-You-Won't.com and its operators from any claims, damages, losses, or expenses arising from your use of the Site or violation of these Terms.

14. Privacy Policy

Information we collect: the display name you choose for the leaderboard, your payment amount, an email address only if you choose to provide one, and basic anonymous analytics (device type, referring page, pages viewed) used to operate and improve the Site.

How we use it: to display leaderboard entries, verify and record payments, respond to your messages, and operate the Site. We do not sell, rent, or share personal information with third parties except as required by law or as necessary for payment processing. We do not run third-party advertising or tracking networks.

Payment data: your payment details are handled entirely by the payment service you choose (e.g., Cash App) under its own privacy policy. We never see or store card numbers or bank details.

Your choices: to request removal of your display name from the leaderboard or deletion of an email address, contact us at legal@bet-you-wont.com. All data handling complies with applicable Colorado privacy laws.

15. Governing Law and Dispute Resolution

These Terms shall be governed by the laws of the State of Colorado and applicable U.S. federal law, without regard to conflict of law principles. Any disputes shall be resolved exclusively in the state or federal courts located in Colorado. You waive any right to participate in a class action lawsuit or class-wide arbitration.

16. Modifications

Sponsor reserves the right to modify these Terms at any time. Changes will be posted with an updated date. Continued use constitutes acceptance.

17. Severability

If any provision is found invalid, remaining provisions remain in full force.
